Lukebra Allison tragically killed in Carthage motorcycle accident


Panola County, Texas ­– Lukebra Allison, 42, tragically lost his life in a motorcycle accident on September 9. The Texas Department of Public Safety was notified of an accident at the intersection of U.S. 79 and County Road 329 in Carthage around 10:35 p.m.

DPS reported Mr. Allison was southbound on U.S. 79 when a semi-truck stopped at County Road 329 began turning left, obstructing Allison’s lane of travel. Reports indicate Allison was unable to maneuver his motorcycle away from the truck and crashed into its side.

According to a local news report, Allison was pronounced dead at the scene of the accident. The driver of the semi-truck sustained minor injuries and was released from the scene upon treatment. No further information was made available at that time.

COMMENTARY BY ROB AMMONS

Reports indicate the troopers have a pretty clear understanding of the events leading to this accident. However, it is important not to attribute this accident to the fault of Mr. Allison. While police believe Mr. Allison was speeding at the time of the accident, the driver of the truck had a duty to ensure the roadway was clear prior to beginning his turn. An accident reconstruction may need to be conducted to determine the exact sequence of events.

Typically, when I handle a case where both parties have a degree of fault, the other party’s insurance providers are quick to point blame at my client to escape liability. However, the law is not that black and white. Instead, the law is designed to account for all factors contributing to the injury and to weigh those factors. In this case, it seems the truck driver’s failure to keep a proper look was the leading cause of this young man’s death.
