Commentary on the fatal car crash in Montgomery County, Texas
This is a horrific accident that will cause unspeakable pain in the lives of the deceased’s family. The reports clearly indicate the cement truck driver negligently disregarded a traffic signal and plowed into the innocent victim’s vehicle.
Negligence here is apparent, and the deceased’s family deserves justice for the pain and suffering they must endure because of the commercial driver’s reckless actions. The losses sustained from the unexpected passing of a husband and father are difficult to measure. The law has established various remedies that can assist the family as they move forward. For instance, the law can hold the driver accountable for the lost income the father would have provided his family, the lost love and companionship the wife will be deprived of due to the passing of her husband, and the lost guidance and support the deceased’s children will experience without a father.
The first step in this process is learning what happened. My firm has handled numerous cases similar to this one, and we have found such negligent behavior is often the result of some other action. For instance, the driver could have been distracted, fatigued, or impaired. Alternatively, the driver could have been unfit to operate a commercial vehicle. A detailed investigation will provide further insight into the mind of the commercial driver and the actions of the driver’s employer leading up to the accident. If the employer puts an unfit driver on the roadways, they too must account for their actions.
I pray the family of the deceased can find the strength to endure this difficult time and have peace as they move forward.
