Fatal truck accident on Interstate 430 in North Little Rock, Arkansas
One can only imagine the horrific scene as three motorists were struck dead by a semi-truck. Although we do not know whether the three decedents had taken the proper precaution to warn other travelers of their presence, one must wonder why the semi-truck driver failed to avoid the disabled vehicle.
If Scott, Flowers, and Plaster had illuminated the car’s hazard lights or had set up cautionary cones leading up to the disabled vehicle, then the semi-truck driver should have seen the group and the stopped car. Sometimes, however, semi-truck drivers are negligent; they may be distracted while driving and fail to see hazards before it becomes too late.
Should investigators find that the semi-truck driver was distracted by a cell phone, a tablet, or even fatigue, the loved ones of Scott, Flowers, and Plaster may be able to bring a direct claim of negligence against the truck driver. Alternatively, if the truck driver was employed by a commercial trucking company and had a record of driving carelessly, the families might also be able to pursue a legal claim against the trucking company for negligently selecting the driver and requiring the driver to complete overnight hauls. After all, this accident did occur in the early morning hours when not many other motorists are on the road; a disabled vehicle, if adequately illuminated, should have been avoidable.
