FORT STOCKTON, Texas—Two people were killed after a semi-truck overturned on I-10 near Fort Stockton, Texas. The accident occurred around 7:45 p.m. along I-10, where the interstate crosses Cedar Street, on October 14, 2022.
According to initial reports, a 36-year-old man from San Benito and a 23-year-old woman were traveling eastbound on I-10 in a semi-truck when a tire blew out. The semi-truck driver lost control and ran off the road, and overturned.
Both people involved in the accident passed away. No further information about the accident is available.
Parties responsible for the tire failure must be held accountable for their wrongdoing.
Unfortunately, tire failures account for many of the fatal crashes we see on our nation’s roadways each year and is the area of practice our firm focuses on. We have been seeing an increasing number of accidents caused by steer axle tires blowing under normal operating conditions. This is very concerning, and action must be taken to remove dangerous tires from our roadways and protect innocent truck drivers from death. Tire failures are mostly preventable, and those responsible for this accident must be held accountable for the harm caused by their failures. The families of the deceased should not suffer the financial consequences of a loved one’s passing when corporate manufacturers are making billion.
Tire manufacturers must ensure that their tires are designed and made to withstand reasonable road conditions, terrain, and pressure changes. To do so, manufacturers typically subject tires to rigorous quality testing. Sometimes, however, tire manufacturers do not detect flaws in their tires before sending them to automakers or consumers. A tire defect, such as a propensity for the tire to overheat and pop, can have catastrophic consequences for drivers across the nation, and tire manufacturers must compensate victims of tire failures for their defective products.
Additionally, tire repair shops have a duty to consumers to maintain tires safely. However, repair shops can also be partially liable for accidents resulting from inadequate tire repair, especially when an employee of a repair shop is aware of the dangerous condition of the tire.
In cases where semi-trucks are involved, commercial trucking companies regularly get their trucks serviced by the same shop and purchase tires from one manufacturer. Therefore, it is often in the best interest of crash victims or their families to consult with an attorney to determine whether the tire manufacturer or repair shop may share in the liability for their loss. While police may not immediately recognize a tire defect as a cause of the accident, trained lawyers can identify the party ultimately responsible for the tire blowout and hold them responsible for their wrongdoing.
