Houston, Texas – The Ammons Law Firm has filed a lawsuit against Bridgestone Corporation on behalf of an Arizona man who was injured during a rollover crash after being hit by a truck that suffered a sudden tire failure.
The accident occurred in Maricopa County, Arizona, on May 12, 2021, when a Bridgestone R238 tire mounted on the left front axle of a Box Truck failed, causing the truck’s driver to lose control and crash into the side of the plaintiff’s vehicle, which made it vault over a guardrail. The plaintiff suffered severe injuries after the car traveled down a concrete embankment and rolled before coming to rest on the shoulder of Interstate 10.
The case filed in the Superior Court of the State of Arizona for the County of Maricopa alleges that Bridgestone designed, manufactured, assembled, and sold the tire that was unreasonably dangerous because it was prone to tread-belt separation.
The lawsuit claims that Bridgestone failed to adequately research, develop, and select tire components that provide adequate strength to prevent a tread separation in foreseeable conditions. The lawsuit contends that Bridgestone failed to use adequate materials to reinforce the belt package, even though such reinforcement was feasible, used in the industry, and employed by other tire makers, and failed to use components with sufficient thickness to minimize air permeations into the internal structure of the tire.
The National Highway Traffic Safety Administration (NHTSA) reports that some 78,000 accidents occur every year due to tire failures, accounting for more than 600 fatalities and 10,000 injuries.
