A Houston man sustained fatal injuries while waterproofing the roof of a fabrication shop. When a rooftop panel gave way, he was caused to fall into the building. His head struck a table resulting in massive brain trauma. The man was rushed to the hospital but could not be saved. He died the next day.
In a lawsuit filed by Rob Ammons on behalf of the man’s father and minor son, it is alleged that the building’s owner as well as the entity contracting the waterproofing service failed to properly inspect the premises for latent defects and failed to keep the premises in a reasonably safe condition. The lawsuit also states that the worker, who was an “invitee” on the premises for the benefit of others, was not warned of hazards that were present at the premises.
“This young man was owed a duty under Texas premises liability law. The condition of the roof on which he was working posed an unreasonable risk of harm to him. As a result, his life was lost.”
