A cash settlement was negotiated by The Ammons Law Firm in a negligence lawsuit against an oil and gas industry drilling tool supply company on behalf of a 27-year-old Texas man. The man, belted in his Suburban, had come to a stop on a Harris County roadway when a large work pickup changed lanes behind him and struck the left rear quarter of his Suburban with such force that it actually rolled over, resulting in orthopedic and neurological injuries. The work pickup was owned by the tool supply company and was being driven by one of its employees who, according to the company, was not “on the job” at the time of the collision but had permission to be operating the pickup.
The lawsuit Ammons filed for the injured driver contained allegations that the employee was negligent and reckless in changing lanes when unsafe, in failing to keep a proper lookout, in being inattentive, and in driving too fast. According to data obtained from the tool company pickup’s computer, it was traveling over the speed limit seconds before the collision. The employee was also ticketed by DPS at the scene.
Ammons claimed that the tool company was liable for its employee’s negligent conduct because it had carelessly entrusted to and allowed him to drive the work pickup without having in place a driving safety program.
“The company showed a complete lack of interest in building a culture of safety within the organization with respect to ensuring its vehicles and workers were not endangering the motoring public,” said Ammons.
At the Defendant tool company’s insistence, the amount of the settlement is confidential.
