Family of Texas Lawyer Rear-Ended by UPS Truck Compensated

The Ammons Law Firm has successfully concluded a case involving a preventable traffic collision that left a 48-year-old Texas lawyer severely brain-injured.

The lawyer was driving on Interstate 10 in Louisiana when he was struck from behind by a UPS tractor-trailer. A lawsuit was brought against UPS and its driver.

The lawsuit alleged that the UPS driver acted negligently and caused the collision by failing to keep a proper lookout and failing to maintain control over the truck. Ammons alleged that UPS, as the truck driver’s employer, was responsible for the truck driver’s negligent conduct because the truck driver was in the course and scope of his employment with UPS at the time of the incident. Ammons also alleged in the lawsuit that UPS failed to properly manage its drivers, noting that this particular driver had been involved in prior accidents that UPS itself had determined were avoidable. A majority of the damages sought by the wife and children of the injured lawyer focused on loss of support. The children’s father would never be able to return to work, and experts placed his past and future lost earnings at a present value of nearly $10 million, much of which would have gone to the economic support of his sons who were only 12 years old when their father was injured.
