The Ammons Law Firm has filed a lawsuit on behalf of a family of four who were all seriously injured when the 2016 Hyundai Sonata in which they were traveling in was struck from behind by a Sears van. The 2007 Econoline van which struck the family was owned and/or operated by Sears Carpet & Upholstery Care at the time of the crash.
In the lawsuit, attorneys Rob Ammons and Justin Burrow claim that the Sears’ driver was negligent in his duty to act as a reasonable and prudent vehicle operator and failed to properly control his speed, keep a proper lookout, and timely apply his brakes to avoid the collision. Further, the lawsuit states that Sears was also negligent as the employer of the driver in that it failed to properly train its employee on safe driving practices and safe operation of the commercial vehicle. Since the driver was on the job at the time of the collision, Sears is legally responsible for his negligence.
