Trucking Company and Enterprise Sued Following Fatal Crash

A Texas man was fatally injured when a tractor-trailer failed to pay proper attention when approaching a controlled intersection, striking the 2020 Chevrolet Silverado he was a passenger in. Although the man was properly restrained, the vehicle, which was rented from Enterprise Rent-A-Car, had a defective restraint system, causing the man to be ejected. The Ammons Law Firm has filed suit alleging that the driver of the tractor-trailer, his employer, and Enterprise are at fault for this man’s death.

On behalf of the man’s family, attorneys Rob Ammons and Kacy Shindler bring suit against the driver of the tractor-trailer, alleging that he failed to exercise reasonable care, failed to maintain a proper lookout and pay attention, and failed to timely apply his brakes to avoid the collision. Further, the lawsuit states that the driver’s employer is liable for the conduct of its driver, alleging that the employer failed to properly supervise its driver and failed to enforce company safety rules.

Also named in the lawsuit is Enterprise Rent-A-Car for negligently renting a vehicle that was equipped with a defective restraint system. In the lawsuit filed by Ammons and Shindler, it is alleged that Enterprise failed to meet its duty as a rental car company when allowing a defective vehicle to be rented by a consumer.
