The Ammons Law Firm Files Suit Against FedEx for an Accident in Tulsa, Oklahoma


Houston, Texas – The Ammons Law Firm has filed a lawsuit against Federal Express Corp. on behalf of a man who was struck by a delivery driver who failed to follow the rules of the road and collided with his vehicle in a suburb of Tulsa, Oklahoma.

The lawsuit filed in the District Court of Tulsa County, Oklahoma, alleges that FedEx did not provide its driver with the training or level of supervision that are customary in the delivery industry and necessary to assure the safe operation of delivery vehicles.

The lawsuit claims that the driver hired by FedEx failed to control his speed, properly brake, keep a proper lookout, navigate a corner, and take adequate and evasive action, which caused him to crash into the plaintiff’s vehicle. The FedEx driver also did not yield the right-of-way when approaching the intersection, causing a crash that left the plaintiff with severe and ongoing injuries.

The lawsuit further alleges that FedEx was negligent in entrusting its delivery van to its driver. It also alleges that the delivery company did not investigate prior similar crashes involving its other drivers to improve policies and procedures. In addition, FedEx did not adhere to industry standards and best practices by adequately training its personnel, neglecting to provide instructions on safe driving and safety rules that would have prevented the accident.

The National Highway Transportation Safety Administration (NHTSA) reports that a large majority—up to 94%—of all motor vehicle accidents are caused by some human error. Among the top culprits are speeding, aggressive/reckless driving, and distracted driving. The National Safety Council also reports that approximately 4.8 million people were seriously injured in automobile collisions in 2020.
