Thoughts on fatal accidents and potential remedies available to the surviving family of Joshua Graves
While we do not have many details on this crash, we can say it was almost certainly preventable. Our deepest sympathies are with the victim’s loved ones at this time; we hope they receive the answers they deserve as soon as possible.
One thing that stands out about this crash is the time. It happened in the early morning hours when there are typically fewer cars on the road, and visibility for truck drivers is relatively good. This suggests that an investigation should focus on the truck driver’s conduct. We often see drivers slack on checking their blind spots, putting down their phones, and/or driving with caution when they know fewer cars around. Drivers must adhere to safe driving practices, and fewer cars around than usual is no reason to ignore them. If it is found that the truck driver, in this case, exhibited any negligent behavior, the victim’s loved ones may have an opportunity to state a claim against them.
The crashworthiness of the Malibu should also be investigated. Crashworthiness standards govern safety features like seat belts, head restraints, roof strength, airbags, and more. They are intended to ensure that vehicles can protect passengers in the event of a crash. If it is found that the Malibu did not meet these standards, the victim’s family may be able to recover against either the car manufacturer or the relevant service shop, depending on which part of the vehicle was found to be lacking and whether any maintenance had been done.
While we must wait for the investigation results to say for sure, the facts strongly suggest this accident was avoidable and likely the result of negligent behavior. The victim’s family deserves answers and the opportunity to hold any wrongdoers accountable for the loss of their loved one.
