One Injury in I-70 Semi-Truck and Car Accident in Clay County, Indiana

CLAY COUNTY, Ind. — A passenger vehicle on Interstate 70 attempted to change lanes from the median to the emergency lane due to a flat tire when a semi-truck struck it from behind. Following the impact, both vehicles veered into the median, where they came to a stop.

The passenger vehicle driver was transported to the hospital with non-life-threatening injuries. The semi-truck driver was uninjured in the accident.

No further details have been provided.

Thoughts on Semi-truck That Crashed into a Passenger Vehicle with a Flat Tire

The U.S. General Services Administration Office of Motor Vehicle Management (UGSAOMVM) reports that driver error causes 98% of all accidents on the road. This is especially true with rear-end collisions, which are almost the fault of the person slamming into the vehicle in front of them. The top five reasons for driver error include speeding, distraction, fatigue, and incorrect assumptions about other drivers (UGSAOMVM). When truckers commit driving mistakes, and their actions cause serious injuries or deaths, they need to be held accountable for their negligent actions.

Even though we do not have all the details from the news release, we know the truck driver slammed into the vehicle from behind. Was the trucker distracted? Speeding? An investigation by trained professionals will be able to answer these questions and determine the liability of the truck driver and if other parties are responsible as well.

When accidents cause serious injuries or deaths, the law is concerned with holding all responsible parties accountable. This means the trucking company that hired the trucker may also be accountable if they failed to take reasonable steps to ensure the driver was qualified to operate a commercial vehicle. Trucking companies have a duty to the public to provide safe drivers on the roadways.

Moreover, trained professionals will also investigate what caused the victim’s flat tire. If the tire had gone through recent maintenance and was a faulty job, the maintenance shop may also be partially responsible for creating a dangerous situation that resulted in an accident.

Once all the facts continue to come out, we can determine all parties responsible that need to be held accountable for their negligent actions. I wish the victim of this accident a speedy recovery.
