More Details Needed to Determine Any Wrongdoing that Caused the Crash
When road collisions happen, the law is concerned with the actions of all parties involved in the crash. Many crashes occur because of a series of mistakes made by both parties. Sometimes, these mistakes include the failure to prevent an impending crash. When a party fails to avoid an accident due to negligence or distracted driving, they may also be at fault for any injuries or death suffered in the collision.
We recently handled a case for a client whose family was killed in a truck accident. The police reports were clear that the deceased failed to yield the right of way to the oncoming truck. However, after investigating the crash, we gained access to video footage of the truck driver scrolling on his cell phone in the moment leading up to the collision. In fact, because the trucker was distracted, he waited until the very last second to take any evasive action and in haste, pulled hard left, striking the vehicle. Had the driver been paying attention, he would have had sufficient time to move right and easily avoid striking our client’s family. Both parties made a mistake, but only one paid the ultimate price and left behind a grieving family. Distracted driving is never okay; those who practice it must be held accountable.
It is too early to tell what happened here. However, when a life is lost in an accident with another motorist, the family of the deceased deserves a thorough investigation the provides clear answers to what happened. If wrongdoing is identified, the family should be provided a right to hold the wrongdoers accountable for the financial and emotional suffering they will experience from the unexpected loss of their loved one.
