Dallas County, Texas —The Ammons Law Firm has filed a lawsuit against The Sherwin-Williams Company, seeking monetary relief exceeding $1,000,000.00 for a motor vehicle crash that occurred in Dallas County, Texas. The incident unfolded when the plaintiff, operating a 2015 Nissan Murano, was stopped at a red signal light in the left lane at the westbound 6000 Linden Lane. The second plaintiff was accompanied her as a front-seat passenger. As they entered the intersection upon the light turning green, their vehicle was struck by a 2020 Ford F-450 truck, driven by the defendant, who ran the red light at the intersection of 12700 Preston Road / State Highway 289 and Linden Lane.
The force of the impact was so severe that it propelled the Nissan Murano across the southbound lanes, onto a sidewalk, killing a pedestrian seated on a walker. Both plaintiffs sustained serious injuries from the crash and were rushed to the hospital. The driver’s injuries were particularly severe, including internal injuries, multiple fractures, and spinal injuries that required intubation in the intensive care unit. The passenger also suffered from fractured ribs, bruising, and internal injuries.
The lawsuit asserts that at the time of the accident, the defendant driver was acting as an employee or agent of The Sherwin-Williams Company, making the company vicariously liable for his actions. The suit asserts The Sherwin-Williams Company with independent negligence for failing to properly train, monitor, supervise, and ensure the safe operation of its Ford F-450 and trailer by its employees, directly contributing to the cause of the crash and the plaintiffs’ subsequent injuries and damages.
