The lawsuit revolved around a tragic event that occurred near the outskirts of Fresnillo, Zacatecas, only 40 minutes away from the plaintiffs’ destination. While traveling to Mexico to visit family and introduce their baby to their extended family, the family’s Chevrolet pickup experienced a catastrophic tire failure. The vehicle lost control, rolled over, and came to rest on its side. Despite their efforts, the mother and four-month-old child lost their lives.

The lawsuit focused on the responsibilities and liability of Cooper Tire, the manufacturer of the failed tire. The tire in question, a P265/75R16 Cooper Telstar Radial SUV tire, was manufactured in Cooper Tire’s plant in Tupelo, Mississippi. After inspecting the tire, the Ammons Law Firm alleged the tire was defective, and the defects led to the sudden failure.
During the inspection, ALF found evidence of pre-existing conditions resulting from defects in the tire’s manufacture, including insufficient rubber at critical belt edges, aged components, and incomplete bonding. These defects allegedly led to belt-to-belt separation tire failure and the fatal rollover crash that left two dead.
Attorneys from the Ammons Law Firm alleged that Cooper Tire’s knowledge of competitors using more rubber at the belt edges, coupled with their failure to ensure adequate rubber coverage in their tire, contributed to the increased likelihood of catastrophic malfunction. The Ammons Law Firm argued that Cooper Tire is liable under strict liability for defects in the tire, including the manufacturing defects identified during the investigation.
The settlement reached in this case acknowledges the devastating loss suffered by the plaintiffs and compensates them for their pain, suffering, and damages. While no amount of money can fully heal their wounds, the resolution brings a sense of closure to this tragic chapter.
