Personal Injury Lawsuit Filed Against Enstructure Richardson LLC for Man Killed in Truck Accident

The Ammons law firm filed a lawsuit on behalf of the surviving family of a man killed in an accident with a tractor-trailer. The crash occurred while the decedent was traveling in a 2013 Chevy Equinox northbound on FM-2978. According to the lawsuit, the driver of a 2020 Mack truck, operating under the authority of Enstructure, caused the fatal collision when he failed to complete a turn into a business parking lot. The lawsuit alleges direct negligence claims against the driver, who obstructed lanes of traffic in hours of darkness. 

The lawsuit further alleges direct negligence against the trucking company. According to the lawsuit, Enstructure loaded, or allowed to be loaded, steel beams improperly, causing the beams to shift during transport. The lawsuit further alleges that the company caused/ or allowed the oversized load of steel beams to be transported in hours of darkness against regulations and without a proper permit. According to the investigation report, the trailer lacked proper lighting, making the flatbed obstructing the lane of traffic virtually unseeable to oncoming motorists. 

The plaintiffs seek punitive damages, alleging that the company’s failure to comply and abide by its permit, including, but not limited to, those related to the length of cargo it could legally haul, the length of the trailer it could legally haul, hauling at nighttime when it was not permitted to do so, and hauling at nighttime with inoperable rear lamps and without lamps or reflectors on either side of its load constituted gross negligence.
