Ammons Law Achieves $3 Million Verdict in an Arizona Medical Malpractice Lawsuit

PIMA COUNTY, ARIZONA-Rob Ammons, Mike McNamara, Claire McNamara, and Raina Newsome achieved a $3 million verdict against the last remaining defendant in a hotly contested medical malpractice lawsuit in Pima County, Arizona. The lawsuit was brought before the Arizona State Court on behalf of the family of a 46-year-old man who tragically lost his life following a failed bariatric operation.

Ammons’ client was admitted to Tucson Medical Center on two occasions, January 13-18, 2020, and January 25-26, 2020. Dr. Monash, who served as the attending surgeon during the bariatric surgery on January 13, 2020, and his primary treating physician throughout his hospitalizations, was shown to have failed to meet the expected standard of care and, as a result, caused the death of the man.

After reviewing the evidence over the course of a three-week trial, a Pima County jury found that the negligence of Dr. Jeffrey Monash caused the 46-year-old man’s death and awarded his wife and children $3 million in damages. All other defendants settled with the plaintiffs prior to trial. This verdict and settlement serve as a reminder of the importance of holding medical professionals and institutions accountable when they fail to protect their patients from clear negligence.
