What Non-Economic Damage Are Available in a Personal Injury Lawsuit?

Accidents happen with no more than a moment’s notice, but the effects of an accident can last a lifetime. While non-economic damages are harder to quantify and more difficult to assign a monetary value to, their significance is enormous. Frequently recovery for non-economic damages is much greater than the economic damages awarded by the judge or jury. Statute of Limitations in Personal Injury Lawsuits

Under Texas law, a person wrongfully injured by another’s conduct must bring a claim to recover damages within two years from the date the injury occurred. If the injury resulted in death, the surviving family must bring a lawsuit against the wrongdoer within two years from the date of passing. Except in rare circumstances, the statute of limitations conclusively precludes recovery. The U.S. Supreme Court said, “Statutes of limitation … in their conclusive effects are designed to promote justice by preventing surprises through the revival of claims that have been allowed to slumber until evidence has been lost, memories have faded, and witnesses have disappeared.” While an injured victim has a right to recover from the wrongdoer for all harm caused by the wrongful conduct, such action must be initiated within the statute of limitations provided by law.
